Our extensive expertise and unique tools can help your linguistic situation!

Are you one of the exceptions? Get a quick overview of your situation!

It takes just five minutes to answer this series of questions* that can help you quickly assess your situation. What’s more, these questions will help you clarify the prerequisites for complying with the overriding and enforceable sections of the Charter of the French Language.

The following considerations can make an enormous difference in preparing your compliance file with the OQLF.

Section 144 has a specific function in the Charter of the French Language, as it permits consideration of companies that cannot generalize the use of French because the nature of their activities requires them to generally use a language other than French as their language of operations. This section establishes a framework for exception to the generalization of French and this exception is governed by two regulations that explain which companies are eligible and for whom, how and within which limits the exception might apply.

Requirement to know a language other than French (sections 46 and 46.1) Do not require the knowledge of a language other than French to stay in a position or to access a position unless this knowledge is necessary to perform the duties, after having first taken all reasonable means to avoid imposing such a requirement.

*The tool is not an official assessment of your situation. Your answers will reveal some non-compliances to work on and aspects that you didn’t think were related to preparing your file. Answer based on your company’s overall situation in Quebec.

If you answered yes to one or more of these questions, you may be eligible for a special agreement. Contact us to find out how to benefit from the flexibility of the Charter!

Clarifying these considerations has enabled our clients to assert their rights with the OQLF. Remember that the Charter is not designed to prevent a company from working, even in English, or to hinder its operations.
